FDA Commissioner Robert Califf said a rise in teenagers using vaping products pushed the FDA to take a thorough look at e-cigarettes. This past Thursday, a regulator said Juul must stop selling and distributing products, and products on the market must be removed. If not, they face enforcement action.

Califf gave more detail on the move in a statement: "The agency has dedicated significant resources to review products from the companies that account for most of the US market. We recognize these make up a significant part of the available products, and many have played a disproportionate role in the rise in youth vaping.”

In 2019, the CEO of Juul—a vape brand, stepped down from the company after there was a nationwide ban on e-cigarettes. The company then reportedly pulled all advertising in the United States. Now, news surfaced noting the brand has been ordered to pay $40 million in a lawsuit settlement that alleges they targeted teens with their advertising.

JUUL lost the settlement to North Carolina, and the news was revealed by North Carolina attorney general Josh Stein. The settlement is reportedly the first one to be reached by the company with a state government, and the trial for the incident was supposed to begin in July 2021.

AG Stein spoke about JUUL in a press conference, revealing why he went after the company. Stein said “Juul sparked and spread a disease, the disease of nicotine addiction. They did it to teenagers across North Carolina and this country simply to make money. Their greed is not only reprehensible, it is unlawful.”

It was noted that in the suit, JUUL won’t have to admit to any wrongdoing in the situation. A spokesperson for the company said, “We look forward to working with attorney general Stein and other manufacturers on the development of potential industrywide marketing practices based on science and evidence.” Despite the $40 million settlement, JUUL is reportedly facing over 2,000 lawsuits due to its e-cigarette marketing.

Previously, it was reported that Juul pod use resulted in a college student suffering a collapsed lung. Since then, Juul along with vaping in general has become public enemy number one, resulting in a nationwide ban on e-cigarettes. Because of that, CEO Kevin Burns stepped down from his position and was swiftly replaced by KC Crosthwaite. Now, it has been revealed that Juul will be stopping all advertising in the United States.

Crosthwaite issued a statement saying “I have long believed in a future where adult smokers overwhelmingly choose alternative products like JUUL. Unfortunately, today that future is at risk due to unacceptable levels of youth usage and eroding public confidence in our industry. Against that backdrop, we must strive to work with regulators, policymakers and other stakeholders, and earn the trust of the societies in which we operate. That includes inviting an open dialogue, listening to others and being responsive to their concerns.
