Update 06/03/2020 10:51am:

Louisville Police released footage which they claim shows local BBQ owner David McAtee firing at them first, leading them to return fire, which hit McAtee and killed him early Monday (June 1) morning

Interim Chief of Police Robert Schroeder addressed the footage, which was taken from security cameras outside of McAtee's business, YaYa's BBQ. Schroeder stated that the video "appears to show McAtee firing a gun outside his business door as officers using pepper balls to clear [Dino's Food Mart] lot approached his business." LMPD Training Division commander Maj. Paul Humphrey followed up by saying that they still have to "put all the pieces of the investigation together."

This comes after Louisville Mayor Greg Fischer announced that LMPD Chief Steve Conrad would be fired ahead of his planned July 1 retirement. Conrad announced that he would be stepping down amid criticism over the Breonna Taylor officer-involved shooting case in which Louisville EMT Taylor was killed and an officer was shot. Mayor Fischer revealed that Conrad would be fired after he discovered that none of the police officers involved in McAtee's death had their body cameras activated.

According to reports, FBI Louisville, Kentucky State Police, and the U.S. Attorney’s Office are investigating the death of popular restaurant owner David McAtee who was shot and killed by police on Monday morning. The Louisville Metro Police officers, in conjunction with the National Guard, were reportedly trying to disperse a crowd around 12:15 AM in the parking lot near McAtee's restaurant, Yaya's BBQ when shots were fired.

Authorities say that they are still interviewing persons of interest but it remains unclear which officer fired the fatal shot which struck McAtee. During Monday's news conference Louisville Metro Police Department Chief Steve Conrad said, “It’s very clear that many people do not trust the police. That is an issue we’re going to work on and work through."
