According to reports, a Texas man is in custody over the murder of a parking lot scammer whom he killed while on a date. 

Erick Aguierre, 29, reportedly left his date with the woman and killed a man, Elliot Nix, 46, who swindled him out of $40 before returning to the restaurant and resuming his date. 

Per the New York Post: "Aguierre and the woman parked separately in a lot in the city’s EaDo neighborhood. The pair was approached by Nix, who lied and said he was a parking attendant and asked for $40 for both of their cars." 

“There was a waiter who knew that the guy was scamming people for parking, and he advised them, ‘Hey, that guy is scamming you for parking,’” said Rick DeToto, an attorney for Aguierre's date. Learning this news left Aguierre incensed as witnesses saw him retrieve a handgun from his vehicle before chasing down Nix.

The witness said they didn't see Aguierre fire the shot but heard it ring out just before 8PM. Afte leaving Nix's body on the side of the road, he "nonchalantly" returned to his date. De Toto told news outlets “…At some point, [Aguierre] said he was uncomfortable with the restaurant and they left” to eat elsewhere. 

"Aguierre’s date had no clue what had happened until police released photos of the two together and said they were wanted for questioning in connection with the shooting." She went to the police and was interviewed by investigators on April 13. Augierre was subsequently arrested on April 25, ten days after a warrant was issued for his arrest.
