According to reports, U.S. Magistrate Judge James P. Mazzone ruled against Jimmy Henchman's claim that former President Donald Trump commuted his prison term. Henchman's legal team claims that Trump granted the disgraced record executive clemency over the phone but there is no official documentation confirming the matter. 

“The undersigned agrees with respondent that the communication at issue in this case was not publicly communicated,” the judge wrote. “Petitioner argues that the form of an act of clemency does not matter so long as the President communicates it publicly. According to the declarations of Jim and Monique Brown, the communication at issue was a phone call between the Browns and President Trump, along with unidentified people in the room with the President. The undersigned agrees with respondent that this was not a public communication. Indeed, it is hard to imagine a less public communication.”

In 2020, Jimmy Henchman lost an appeal related to the murder of an associate of 50 Cent. Now, Henchman is back in the news, this time pushing forward with an alleged pardon that was promised to him before Trump left office. Despite Trump calling one of the advocates for the release of Henchman—former NFL player Jim Brown to speak on the sentence being commuted, the man was not released. Following the failed pardon, Trump left the White House months later.

Attorneys reportedly wrote a 20-page petition that went on to say, “Rosemond is serving a sentence that no longer exists.” The petition was filed in West Virginia, and attorneys for Henchman say the conversation Trump and Jim Brown “constituted a public communication that he was commuting Rosemond’s sentence.” They continued saying Jimmy’s “this exact situation is unprecedented — it does not appear to have happened in the history of the United States.”

Michael Rayfield, an attorney for Henchmen, went on to say, “it’s clear to me that Jimmy doesn’t belong in prison for another day.” Jim Brown and his wife wrote about their conversation with Trump, saying, “Based on my conversation with President Trump, I believe that Mr. Rosemond’s sentence was commuted on Dec. 18, 2020.” Trump reportedly told the Browns, “I want do this,” and that he “looked at everything” in relation to the Rosemond situation.

As of now, attorneys for Henchman are saying that they have attempted to contact the Biden administration to “act on President Trump’s commutation.” Stay tuned for more updates.
