It was announced on Tuesday (December 28) that Westchester District Attorney Mimi Rocah has declined to pursue charges against former New York Governor Andrew Cuomo for sexual harassment. Rocah explained that "credible evidence" of the alleged misconduct was found, but the instances fell outside the statute of limitations.
Rocah's statement reads, "Our investigation found credible evidence to conclude that the alleged conduct in both instances described above did occur. However, in both instances, my Office has determined that, although the allegations and witnesses were credible, and the conduct concerning, we cannot pursue criminal charges due to the statutory requirements of the criminal laws of New York."
This comes after prosecutors in Nassau County declined to charge Cuomo in a sexual misconduct allegation in their jurisdiction last week. Acting Nassau County District Attorney Joyce Smith addressed the decision, stating, "Our exhaustive investigation found the allegations credible, deeply troubling, but not criminal under New York law." Smith added that "prosecutors in other jurisdictions continue to review other allegations of misconduct by Mr. Cuomo."
