According to reports, a Texas appeals court upheld the conviction of Amber Guyger, the former Dallas police officer who fatally shot her neighbor Botham Jean, while he was in his home.

The decision was made this past Thursday, and a panel of three state judges ruled a Dallas County jury had sufficient evidence to convict Guyger of murder.

As of now, Guyger will continue to serve a 10-year-sentence and will not be eligible for parole until 2024. The woman’s appeal found her saying she mistook Jean’s home for her own and that the shooting that followed was reasonable. Guyger’s lawyer reportedly requested a criminally negligent homicide conviction, which would hold a lower prison term.

Former police officer Amber Guyger was found guilty of murdering her neighbor Botham Jean after entering the man’s apartment in an incident that occurred in 2018. Guyger killed Jean after entering his apartment, thinking the apartment was hers. Now, the lawyers for Guyger have reportedly filed an appeal that asks for a lesser charge after she was convicted of murder.

The appeal argues that evidence submitted in the case “was legally insufficient to prove beyond a reasonable doubt that Guyger committed murder.” The appeal went on to justify Guyger’s actions in killing Jean, saying, “Despite the tragic consequences, considering all the evidence — whether admissible or inadmissible ... Guyger acted reasonably,” and reduced her shooting of Jean to a mistake, saying the woman “simply missed” clues that she went into the wrong apartment. The appeal is arguing for a charge of criminally negligent homicide as a third-degree felony. According to reports, Guyger would be eligible for probation from the jury if that charge was issued.

Amber Guyger was recently found guilty for the murder of Botham Jean, much to the surprise of the general public considering the laundry list of officers acquitted of murder charges for killing unarmed black men. Guyger was sentenced on Wednesday and received 10 years behind bars.
