A prosecutor has confirmed that Bobby Shmurda's lyrics will not be used agaisnt him in his upcoming trial. 

According to The Fader, the Brooklyn rapper and the rest of the GS9 crew are still awaiting bail after being arrested on Dec. 17 outside of Quad Recording Studios in Manhattan. An investigation by NYPD's Brooklyn South Violence Reduction Task Force and the Special Narcotics Prosecutor collected a total of 21 guns from Shmurda and his crew.

While Epic Records initially promised to post the Brooklyn rapper's $2 million bail, Shmurda spent Christmas behind bars. The "Hot N*gga" and his 12-man crew are collectively facing a total of 69 charges. Shmurda has less charges than the rest of his crew, but is still facing 8 to 25 years in prison if found guilty of five charges on eight counts of several conspiracy murder and assault charges.

A representative of the Special Narcotics explained that Shmurda's lyrics will not be included in the trial. His attorney Howard Greenberg disagrees. Greenberg echoed his statements about the police and rappers during his interview with The Fader.

"The government hates rap and the government hates rappers," he said. "They construct a narrative and add rationalizations to make it seem true. They recruit guiltless and loveless people to whom truth is meaningless and convince them to say what they want to say. These people are jealous of a brother on the way up."

Greenberg added that social media posts might be used in the trial, but is more than positive the 20-year-old rapper will be able to walk away from his charges.

"I've analyzed the indictment down to the bone," he said. "It's just talking. Bobby shouldn't be charged with anything. I have told your colleagues in the media, the indictment is a bunch of bullshit. First 41 pages are just kids talking, in not even English. Bobby isn't charged with anything except talk in the indictment. Use your head, it doesn't make any sense. I'm not going to let them crucify Bobby Shmurda."
