While Tracy Morgan is currently struggling to walk again after a Walmart truck struck his limo in a nasty car accident in June, new legal documents have revealed that the company is placing blame on the comedian for not wearing a seat belt during the accident.

According to NJ, Walmart says that if Morgan and the rest of his entourage were wearing seat belts, the injuries would have been less severe, or non-existent.

"By failing to exercise ordinary care in making use of available seat belts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests," Walmart's lawyers stated in the legal documents. "Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise of reasonable conduct using the available seat belts."

The company is using the lack of safety as a defense in a lawsuit issued by the comedian and his party for negligence. The company is refusing to take fault for the car accident that a truck driver employed by Walmart, allegedly caused when he dozed off at the wheel.

Morgan suffered a broken leg, nose and several ribs because of the accident. Morgan's mentor, Jimmy McNair was killed in the accident.

The driver of the truck, Kevin Roper, 35, of Jonesboro, GA, pleaded not guilty to vehicular homicide.
