Tracy Morgan is taking legal action against Wal-Mart after one of the retail giant's truck drivers caused a deadly crash that left the comedian in critical condition.

According to CNN, the comedian filed a complaint on Thursday with the U.S. District Court in New Jersey.

"The defendants' negligence was a substantial contributing factor in causing plaintiffs' injuries," the complaint states.

The lawyers are representing the comedian and three others involved in the crash. Morgan was left with broken ribs, a broken leg and nose injuries. His friend James McNair lost his life. Several others were injured in the accident.

In the lawsuit, the complaint lists driver Kevin Roper as the one responsible for the crash. In his court hearing in June, Roper pled not guilty in the accident.
