Drake has been hit with court docs over a sample used on his platinum album, Nothing Was The Same.

According to TMZ, the rapper didn't ask for permission to use a sample from late jazz musician Jimmy Smith for the album's opening interlude on "Pound Cake/Paris Morton Music 2" featuring Jay Z. The estate also claims the Drake falsely claimed that the song, "Jimmy Smith Rap" was licensed correctly. The song was produced by Boi-1da.

Smith's estate plans to sue the rapper for $300,000 in royalties.
