One day after he was released by the Carolina Panthers, former NFL offensive tackle Michael Oher's week got tougher on Friday, July 21, when he became the subject of a lawsuit filed by an Uber driver he is alleged to have assaulted three months ago in Nashville. Along with report of the court filing, Oher also had to contend with 911 audio taken from the incident being released to the public.

The suit, filed by claimant Girma Berkessa, accuses Oher of pushing Berkessa to the ground and repeatedly kicking him while hurling homophobic slurs during the April 14 attack. A heavily intoxicated Oher “acted maliciously, intentionally, willfully, wantonly, recklessly and/or negligently,” the court documents state. In the audio of Berkessa contacting an emergency dispatcher, his voice indicates that he is in a state of distress, with heavy breathing and sounds of weeping. At one point the aggressor can be heard manhandling Berkessa as he panics about having allegedly been bit, before making a plea for the police.

It becomes clear in the audio that Berkessa was aware that Oher was a football player, when he told the dispatcher that he thought the 6'4, 315 pound Memphis native to be a player from the Tennessee Titans. Berkessa had reportedly picked Oher up to transport him to a Nashville comedy club. The ride went bad when Berkessa, who was supposed to be following Oher's wife on the road, lost her car in traffic. It then became outright violent when Berkessa presented him with the cost of the fare, according to the driver.

Oher is scheduled to appear in court to face the assault charge on October 31.
